Bona Fide Occupational Qualification permits necessary employment discrimination in specific situations. A BFOQ is a legal exemption that allows employers to make recruiting decisions based on protected characteristics such as gender, religion, or national origin if those features are judged essential to the job’s requirements. 

Some professions, such as airline pilots or bus drivers, may impose age restrictions. In certain religious institutions, BFOQ may apply, requiring employees to be members of a specific denomination to perform religious duties. Models or actors may be subject to BFOQ when authenticity in performance, such as gender or age, is deemed crucial for a particular role. The scope of valid BFOQ claims is narrow, and employers must demonstrate a direct connection between the protected characteristic and the job’s essential functions.
